Terms of Use

These terms apply to the use of the Nuanza mobile app ("the app"). By installing or using the app you agree to them. If you do not agree, do not use the app.

2. What Nuanza does

Nuanza analyzes one photo of your face, places you in one of 12 color seasons and shows makeup shades and palettes that suit that season. Your three best-matching palettes come with a fit score and reasons; Nuanza Complete adds them for all 92 palettes (section 3). You can save palettes as favorites.

The app is free to download and has no account and no advertising. One color scan result per installation of the app is free. More is available with Nuanza Complete, a one-time in-app purchase (section 3). A color scan needs an internet connection.

Before your first color scan the app asks for your consent to process the photo of your face. You can withdraw it at any time in the app. The Privacy Policy explains what happens with the photo.

3. Free use and Nuanza Complete

Without paying you get one color scan result per installation of the app. It includes your season, the four readings (undertone, depth, clarity and contrast), the colors read from your skin, eyes, hair and lips, the summary, a selection of your personal shades and your three best-matching palettes. You can browse all palettes and save favorites.

A photo that is not good enough for a reliable reading does not use up your free result. That is the case with low light, a strong color cast, a face that is partly hidden, a suspected filter, or when no face is found. An installation of the app gets at most three attempts to reach its free result.

Nuanza Complete unlocks:

• your full list of personal shades;
• the shades that bring out your eye color, and your best metals;
• the colors that flatter you less and the tips for your season;
• the season closest to yours;
• the fit score and the reasons for all 92 palettes;
• new color scans, within the daily limit in section 7.

Price and payment. Nuanza Complete is a one-time purchase, not a subscription. Nothing renews and there is nothing to cancel. The price that applies is the one the App Store or Google Play shows before you confirm, VAT included where it applies. Apple or Google handles the payment under its own terms, with the payment method of your store account.

Restore. The purchase belongs to the Apple or Google account you bought it with, not to one phone. After a reinstall or on a new phone with the same account, tap "Restore purchase" on the Nuanza Complete screen or in the You tab. A purchase made on the App Store cannot be restored on Android, and the other way round.

Right of withdrawal. Consumers in the European Union normally have 14 days to withdraw from a purchase made at a distance. For digital content that is supplied immediately, that right ends once the supply has started with your prior express consent and your acknowledgement that you lose the right as a result. Nuanza Complete is unlocked immediately after payment. Apple and Google apply this rule in their own terms, which you accept when you buy: Apple states that you can cancel an order within 14 days of receiving your receipt, but no longer once delivery of the content has started at your request and you have acknowledged that you lose the right as a result; Google states that when you buy digital content on Google Play you agree to it being available immediately and acknowledge that you waive the right of withdrawal as a result.

Refunds. Refunds go through the store that received the payment. For the App Store, request a refund at reportaproblem.apple.com; Apple decides, and we cannot refund App Store purchases ourselves. For Google Play, request a refund from Google Play within 48 hours of the purchase; after that, write to hello@easystreet.be and we will look at your request. If Nuanza Complete does not work as described, write to us in any case. Your statutory rights in case of a lack of conformity are not affected.

4. Guidance, not professional advice

• Your result is guidance based on a photo. It is not a professional color consultation.
• Nuanza does not give medical or dermatological advice and says nothing about the health of your skin.
• The result depends on the photo: the lighting, your camera, makeup, a tan, tinted glasses, colored lenses and dyed hair can change it. Two photos of the same person can lead to different results.
• Shades are shown on a screen. Colors look different from one screen to another and differ from real makeup products.
• Nuanza recommends shades, not products. What you buy and wear is your own choice.

5. Who may use the app

You must be at least 16 years old to use the app.

6. Acceptable use

You agree to:

• scan only your own face, or the face of a person who has agreed to it;
• use the app for personal, non-commercial purposes;
• not access the service by automated means or outside the app, and not circumvent the integrity checks or the daily scan limit;
• not copy, modify, decompile or reverse engineer the app, except where the law gives you that right;
• not use the app for anything unlawful or to harm other people.

We may block access for an installation that breaks these rules.

7. Availability and limits

We aim to keep Nuanza working, but we provide it as it is and as available. The service can be interrupted, for example for maintenance or when a provider we depend on is unavailable. We may change, limit or discontinue the app or parts of it.

The number of color scans is limited. Without Nuanza Complete an installation of the app gets one free result, in at most three attempts (section 3). With Nuanza Complete a fair-use limit of 10 color scans per device per day applies. We may change the daily limit for the future; that does not affect the rights the law gives you for content you paid for.

8. Intellectual property

The app, its name, artwork, texts, palettes and software belong to Claes Consultants BV or its licensors and are protected by intellectual property law. You receive a personal, non-exclusive, non-transferable and revocable right to use the app on your own devices in line with these terms.

Your photos remain yours. You give us only the permission needed to process a photo for your color scan, as described in the Privacy Policy.

9. Privacy

How we handle personal data is described in the Privacy Policy.

10. Liability

Nothing in these terms excludes or limits our liability for fraud, intentional fault or gross negligence, for death or personal injury caused by our act or omission, or in any other case where the law does not allow liability to be excluded or limited. Nothing in these terms affects the rights you have as a consumer under mandatory law.

Within those limits, we are not liable for indirect or consequential loss, and not for decisions or purchases you make on the basis of a result. If you bought Nuanza Complete, you keep the legal guarantee of conformity that the law gives consumers for digital content.

11. App Store and Google Play

These terms are between you and Claes Consultants BV. Apple and Google are not a party to them and are not responsible for the app, its content or its support. Your use of the app must also comply with the terms of the store you downloaded it from. If you downloaded the app from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes to these terms

We may update these terms, for example when the app changes. The new version is published on this page with a new effective date. If you keep using the app after that date, the new version applies.

13. Governing law and disputes

These terms are governed by Belgian law. If you are a consumer, you keep the protection of the mandatory rules of the law of the country where you live.

Please contact us first, so we can try to solve a problem together. Disputes are submitted to the Belgian courts. If you are a consumer, you may also bring proceedings before the courts of the place where you live.
